Parliamentary Questions

Question On Notice No. 2605 asked in the Legislative Council on 24 October 2019 by Hon Peter Collier

Question Directed to the: Leader of the House representing the Premier
Parliament: 40 Session: 1

Question

I refer to Infrastructure Western Australia (WA), and I ask:
(a) will the Premier table the agenda and minutes from all board meeting of Infrastructure WA; and
(b) if no to (a), why not?

Answered on 28 November 2019

The agenda and minutes from the board meetings held thus far comprise of more than 250 separate documents. These documents have the propensity to contain, either in part or in full, information that is Cabinet in Confidence, Commercial in Confidence, Personal Information or information that is subject to Legal Professional Privilege.

As such, proper assessment needs be undertaken to determine the extent of which Cabinet in Confidence, Commercial in Confidence, Personal Information or information that is subject to Legal Professional Privilege exists within those more than 250 documents

Given the workload involved in assessing and considering the more than 250 documents, and the need to protect information that is subject to Cabinet in Confidence, Commercial in Confidence, Legal Professional Privilege or information that is personal, it would be appropriate for this request be dealt with through the Freedom of Information process.

As was canvassed extensively during debate on the Infrastructure Western Australia Bill 2019 Bill, Infrastructure WA is subject to the Freedom of Information Act 1992. Furthermore, as the Hon. Sue Ellery told the Legislative Council on 5 June, 2019 during debate of the Bill, the meeting minutes would be accessible via freedom of information.
