HAWTHORN RESOURCES — PINJIN PASTORAL STATION — DAMAGE
      758. Hon ROBIN CHAPPLE to the minister representing the Minister for Lands:
I refer to the mining works being undertaken by Hawthorn Resources on Pinjin pastoral station.
(1) Are proponents allowed to damage fence lines and/or water infrastructure on a pastoral lease?
(2) If yes to (1), can the minister please explain how, with reference to the relevant legislation?
      (3) If no to (1), what steps will the minister take to ensure that damage done to fences and water infrastructure on Pinjin station is repaired?
(4) Are mining companies allowed to impact upon pastoral infrastructure in any way on a pastoral lease?
      (5) If no to (4), what is the permissible distance from pastoral infrastructure within which mining activities can occur on a pastoral lease under acts or regulations of Parliament?
(6) Will the minister investigate the actions of Hawthorn Resources on Pinjin pastoral station?
Hon STEPHEN DAWSON replied:
I thank the honourable member for some notice of the question.
(1) No.
(2) Not applicable.
      (3) Bearing in mind that this answer has been provided by the Minister for Lands, I have asked the Department of Planning, Lands and Heritage to liaise with the Department of Mines, Industry Regulation and Safety to investigate the issue and seek a resolution.
(4) No.
      (5) Under section 20 of the Mining Act 1978, mining activities are not permitted within 400 metres of the outer edge of any water points, including dams, wells or bores, and 100 metres from a yard, garden or stockyard and any occupied land on which there is a house or other substantial building.
(6) Yes.
