Parliamentary Questions

Question Without Notice No. 402 asked in the Legislative Council on 7 May 2019 by Hon Rick Mazza

Parliament: 40 Session: 1

FISHING — LOCAL LAWS — COTTESLOE AND CAMBRIDGE

402. Hon RICK MAZZA to the Leader of the House representing the Minister for Local Government:

It has been brought to my attention that the Town of Cottesloe seeks to impose bans on fishing lines with wire or chain.

(1) Does the Town of Cottesloe's proposal extend seaward 800 metres to the boundary of the fish habitat protection area?

(2) If yes to (1), has the Town of Cottesloe obtained the Governor's approval to allow a local law to extend outside its boundary to fishers on boats who are almost a kilometre offshore?

(3) Is the minister aware that anglers at City Beach, within the Town of Cambridge, were told by rangers that they were not allowed to fish within 500 metres of the groyne?

(4) What jurisdiction does the Town of Cambridge have to justify the above direction being given?

Hon SUE ELLERY replied:

I thank the honourable member for some notice of the question.

(1)–(2) The Town of Cottesloe has not yet submitted any proposal to the minister for comment prior to amending the local law.

(3) No.

(4) The Town of Cambridge has a local law that allows it to regulate fishing on local government property, on boat jetties and in designated swimming areas. The current local law's jurisdiction applies up to 200 metres seaward and was approved by the Governor.
