Question Directed to the: Leader of the House representing the Premier
Parliament: 40 Session: 1

Question

I refer to Legislative Council question on notice No. 576, in relation to the Freedom of Information Act 1992, the information I seek is not entirely available in the Information Commissioner's Annual Report and nevertheless that report will not be available for several months, and I ask again:
(a) from 11 March 2017 to date please provide the following for each department or agency under the Premier's control including the Department of the Premier and Cabinet and each subsequent ministerial office:
(i) the total number of applications received per month;
(ii) how many of those identified in (i), were completed within the 45 day statutory timeframe;
(iii) of those identified in (i), how many applicants were charged a fee beyond the $30 application fee;
(iv) of those identified in (iii), how many applications ceased as a result of the fee requested; and
(v) what is the total cost of additional fees charged by agency, department of ministers office?

Answered on 28 August 2018

(i)-(ii) In accordance with Section 13(3) to the FOI Act, the permitted period is 45 days after the access application is received or such other period as is agreed between the agency and the applicant or allowed by the Commissioner.

The statistical returns of all agencies for the 2017/18 financial year were required to be produced to the Information Commissioner by close of business on Friday 20 July 2018. The Information Commissioner is now required to submit a report to the Parliament of Western Australia on the operation of the FOI Act as soon as practicable.

The statistics for the 2017/18 financial year that have been provided to the Information Commissioner by the Department of the Premier and Cabinet for the Department and each ministerial office include the number of FOI applications received and the number of applications not completed within the permitted period.

(iii)-(v)   Nil
