OPTUS STADIUM — PEDESTRIAN BRIDGE
      119. Hon PETER COLLIER to the minister representing the Minister for Transport:
I refer to the government's decision to cancel the contract with Toyota Tsusho for the construction of the Swan River pedestrian bridge.
      (1) Did the minister receive advice from Main Roads Western Australia on the cancellation of the contract with Toyota Tsusho; and, if yes, will the minister now table that advice?
      (2) In percentage terms, what was the estimated level of completion of the fabrication of the bridge in Malaysia?
      (3) How much money has the state paid to either York Rizzani or Toyota Tsusho specifically for the fabrication of the bridge in Malaysia?
      (4) Does the state intend to take legal action against York Rizzani or Toyota Tsusho to recover money paid in relation to the cancelled contract; and, if not, why not?
      (5) Has the government received any correspondence from Toyota Tsusho following the cancellation of the contract; and, if so, has Toyota Tsusho threatened legal action?
Hon STEPHEN DAWSON replied:
I thank the Leader of the Opposition for some notice of the question.
      (1) The minister received advice on the evening of 15 June 2017 from the managing director of Main Roads in the following terms, according to my notes —
          ''York Rizzani (YR) have terminated their supply agreement with Toyota Tsusho (TT) for the supply of structural steel (deck, three arches and pivot hinges) this afternoon. They have done this on the basis of non-performance in respect of time and quality. TT would not commit to delivery dates and YR have concerns regarding quality. This contract is between YR and TT and Main Roads has no control over the YR right to terminate.''
      The minister will not table that advice because it deals primarily with confidential advice on commercial options for the alternative supply of the structural steel, which is relevant to the current contractual arrangements with Civmec Construction and Engineering and Fremantle Steel Group.
(2) The member will have to ask York Rizzani.
(3) Nil.
(4) Not applicable.
(5) Yes; Toyota Tsusho has not threatened legal action.
