METHAMPHETAMINE — CRIMINAL CODE PROVISIONS

804. Hon COLIN TINCKNELL to the minister representing the Minister for Police:

(1) Is there any extra provision in the Criminal Code that specifically prohibits the use of illicit drugs, such as methamphetamine, around children?

(2) If yes to (1), which section of the Criminal Code deals with this and what are the penalties?

(3) If no to (1), would the perpetrator potentially be charged under a different, wider ranging law?

(4) If yes to (3), which law?

Hon STEPHEN DAWSON replied:

I thank the honourable member for some notice of the question. My copy of the question says ''is there any provision''. The member said ''any extra provision''. I do not think it is material, so I will answer the question I have. The following answer has been provided to me by the Minister for Police.

(1)–(4) Advice was sought from the Western Australia Police Force. The honourable member may wish to refer to section 34(4) of the Misuse of Drugs Act 1981.
