TOBACCO PRODUCTS CONTROL ACT — REVIEW
152. Hon AARON STONEHOUSE to the parliamentary secretary representing the Minister for Health:
I note the minister's commitment, as reported in The West Australian on 20 February 2018, to a review of the state's tobacco laws, which would include e-cigarettes.
      (1) When will this review commence?
      (2) What terms of reference will be employed?
      (3) By what date will the review conclude?
      (4) When can we expect the review's findings to be released?
Hon ALANNA CLOHESY replied:
I thank the honourable member for some notice of the question.
I am advised the following.
      (1) Section 127(1) of the Tobacco Products Control Act 2006 states —
        The Minister is to carry out a review of the operation and effectiveness of this Act as soon as is practicable after —
              (a) 4 years have elapsed since Part 5 comes into operation; and
              (b) every fourth anniversary of that date.
      (2)–(3) This is to be determined.
      (4) Section 127(3) of the Tobacco Products Control Act 2006 states —
        The Minister is to prepare a report based on each review carried out under subsection (1) or (2) and is to cause the report to be laid before each House of Parliament as soon as is practicable after the report is prepared, and in any event in relation to a review under subsection (1), not later than 12 months after the requirement for the review arose.
