Parliamentary Questions

Question Without Notice No. 1311 asked in the Legislative Council on 31 October 2019 by Hon Simon O’Brien

Parliament: 40 Session: 1

FACIAL RECOGNITION TECHNOLOGY

1311. Hon SIMON O'BRIEN to the Leader of the House representing the Attorney General:

I have a question without notice of which some notice has been given to the Leader of the House representing the Attorney General, which is an onerous task I am sure!

I refer to the use of facial recognition technology by the City of Perth, among others, to monitor Western Australians going about their normal lawful activities.

(1) What legislation, if any, regulates the use of facial recognition technology in public?

(2) Are state agencies subject to state government or commonwealth restrictions and/or protocols on the use of this technology?

(3) Which state agencies are using facial recognition technology?

Hon SUE ELLERY replied:

I thank the honourable member for some notice of the question.

Due to the short time frame —

Several members interjected.

Hon SUE ELLERY: Honourable member, I am going to say something at the end of this.

Due to the short time frame and level of detail required to complete this question, the Attorney General requests that it be placed on notice.

I have noticed that there have been three questions today with the same answer. I will undertake to check with the Attorney General's office. With the previous two questions I gave an answer to, a level of detail was required that would be difficult to get in the short time frame, but I will follow it up with the Attorney General.
