BUILDING COMMISSION — BUILDING ORDERS

869. Hon CHARLES SMITH to the minister representing the Minister for Commerce:

I refer to the Building Act 2011.

(1) Has the Building Commission issued any building orders under sections 110 to 118 since 2011?

(2) If yes to (1), how many?

(3) Has the Building Commission carried out any prosecutions since 2011?

(4) If yes to (3), how many?

I thank the member for the question. The following information has been provided by the Minister for Commerce.

(1) No.

(2) Not applicable.

(3)–(4) The powers and processes prescribed in sections 110 to 118 of the Building Act 2011 are for the purposes of issuing and effecting building orders. These powers are conferred to the permit authorities, which, under the act, are established as local government authorities, and, by delegation, a number of state government agencies, including Building Management and Works in the Department of Finance. Only a permit authority can commence a prosecution under the act.
