Question

I refer to the Youth Custodial Rules, and in particular to Rule 102 Youth Custodial Services philosophy and management of young people, which, according to the department’s website is currently ‘under review,’ and I ask:
(a) how long has this rule been under review;
(b) why is the rule being reviewed;
(c) who is being consulted in the review of the rule; and
(d) when is anticipated the rule will be:
(i) finalised; and
(ii) made available on the department’s website?

Answered on 4 June 2019

(a) Youth Custodial Rule 102 - Youth Custodial Services philosophy and management of young people (YCR102) is being reviewed as part of the Custodial Operational Policies and Procedures Project (the project). The project commenced on 5 November 2018.

(b) The purpose of the project is to establish clear, simplified, consistent custodial Operational Instruments to ensure officers involved in the corrections system know what is required of them. The revised Operational Instruments will be regularly reviewed to maintain currency with mandated constraints and contemporary best practice custodial management.

(c) The review of YCR102 will involve a range of relevant internal and external stakeholders including the State Solicitor’s Office.

(d) (i) The review of YCR102 is scheduled to be completed by December 2019. The project is currently on track and scheduled for completion in March 2020.

(d) (ii) The availability of all Operational Instruments on the Department’s external website created as part of the project will depend on the amount of sensitive or restricted information contained within the final document.
