COMMISSIONER — REAPPOINTMENT
525. Hon PETER COLLIER to
the Leader of the House representing the Attorney General:
My question without notice is asked
on behalf of Hon Michael Mischin.
I
refer to the Attorney General's tabling of 7 September 2017 of the
Solicitor-General's legal advice on the proposed amendment of
section 2 of the Corruption, Crime and Misconduct Act 2003 and the Leader of
the Opposition's disclosure on 14 May 2020 of legal advice from a former
Solicitor-General in respect of the proposed amendment of section 9 of that
act.
(1) Can the
Attorney General identify the source and date of any legal advice received
regarding the reappointment of Hon John McKechnie as Corruption and Crime
Commissioner?
(2) Would the
Attorney General, in the public interest and in the spirit of the good faith
that he displayed in 2017, and displayed by the Leader of the Opposition on 14 May,
table legal advice that he has received in respect of the Corruption, Crime and
Misconduct Amendment Bill 2020?
(3) If no to (2), why not?

I
thank the honourable member for some notice of the question. I note that in the
first sentence of the preamble, the question
I have written refers to section 3. The member said, as I heard, section 2. I want
to be clear that it is section 3.
Hon Peter Collier: It should
have been section 3.
Hon SUE ELLERY: The answer is

legal advice is a matter for the Attorney General and it occurs at his
discretion.
