BHP — MT WHALEBACK — LICENCE AMENDMENT

993. Hon ROBIN CHAPPLE to the Minister for Environment:

I am aware that the minister is not in attendance today.

I refer to the BHP licence amendment BHP L4503/1975/14.

(1) When, and by what method, did the Department of Water and Environmental Regulation advertise this amendment to the public?

(2) What prior licence does this amendment relate to?

(3) Will the minister please table the previous licence as referenced at (2)?

I thank the honourable member for some notice of the question. On behalf of the Minister for Environment, I advise the following.

(1) The Department of Water and Environmental Regulation amended licence L4503/1975/14 to correct clerical errors and make formatting changes. The amendment was not advertised for public comment. The amended licence was incorrectly placed on the department's webpage as being open for appeal from 28 August 2020 to 15 September 2020. It was subsequently removed from the webpage as this type of amendment is not appealable under the Environmental Protection Act 1986.

(2)–(3) The amended licence is an amalgamation of the previous licence L4503/1975/14 and three amendment notices. I table the previous licence and the amendment notices dated 20 April 2017, 6 November 2017 and 24 March 2020.
