Parliamentary Questions

Question Without Notice No. 1196 asked in the Legislative Council on 22 November 2022 by Hon Nick Goiran

Parliament: 41 Session: 1

VICTIMS OF CRIME ACT — REVIEW REPORT

1196. Hon NICK GOIRAN to the parliamentary secretary representing the Attorney General:

I refer to the response to my question without notice 1167 on 17 November 2022, in which the Attorney General stated that the department would provide advice on the statutory review of the Victims of Crime Act 1994 following its consultation on the recommendations.

(1) Will that include advice on whether the definition of ''victim'' should be expanded, particularly regarding children who witness a serious offence?

(2) When was the first consultation conducted?

(3) Who is being consulted?

(4) By what date is the department aiming to conclude this consultation?

(5) Has the Attorney requested that the department expedite its work?

(6) If yes to (5), has the Attorney clarified what he means, given his commitment more than five years ago that he would ''expedite'' elder abuse reforms?

Hon MATTHEW SWINBOURN replied:

I thank the member for some notice of the question. The following answer is based on information provided to me by the Attorney General.

(1) Consultation will occur on recommendation 5 of the statutory review.

(2) The recommendations of the statutory review have been discussed at the Victims of Crime Reference Group meetings in April and June 2022.

(3)–(6) Key stakeholders will be consulted. The Department of Justice anticipates providing advice to the Attorney General in relation to the statutory review following its consultation on the recommendations in mid-2023.
