VOLUNTARY ASSISTED DYING — PROSECUTIONS

1182. Hon MARTIN ALDRIDGE to the parliamentary secretary representing the Minister for Health:

I refer to the minister's answer to Legislative Council question without notice 1135 on 15 October 2019 in relation to the intersection of federal law and the Voluntary Assisted Dying Bill 2019.

(1) Given my first request for the minister to table the letter between the commonwealth and the state public service was on 3 September 2019, how long does it normally take to receive advice from the State Solicitor's Office on the minister's ability to satisfy Parliament's request to table one letter?

(2) On what date did the minister request advice from the State Solicitor's Office?

(3) Has the State Solicitor's Office advised when it might be in a position to provide that advice?

(4) Will the minister commit to have the advice tabled in Parliament prior to the bill being read a second time?

Hon ALANNA CLOHESY replied:

I thank the honourable member for some notice of the question.

(1) There is no normal time frame for provision of legal advice.

(2) It was on 18 September 2019.

(3) Yes.

(4) No. The decision to table correspondence will be reliant on advice.
