ABORIGINAL HERITAGE — PROGRAM OF WORK
      561. Hon ROBIN CHAPPLE to the minister representing the Minister for Mines and Petroleum:
I refer to program of work approval registration ID 64489.
      (1) Is the minister aware that four recorded Aboriginal heritage sites that met the criteria of 5(a) and 5(c) of the Aboriginal Heritage Act 1972 were present on the land;
      (2) If no to (1), why not?
(3) If yes to (1), why did the minister issue the program of work approval?
      (4) If no to (1), will the department investigate why this information was not supplied and provide an answer?
(5) If no to (4), why not?
Hon ALANNAH MacTIERNAN replied:
I thank the member for the question. The Minister for Mines and Petroleum has provided the following information.
(1) No.
      (2) The program of work was approved by an environmental officer of the then Department of Mines and Petroleum on 15 March 2017, as allowed for under the program of work provisions of the Mining Act 1978.
(3) Not applicable.
(4) No.
      (5) The information was supplied and available to the department. The Department of Mines, Industry Regulation and Safety has advised the Minister for Mines and Petroleum that the program of work was approved, as information available at the time of the assessment clearly indicated that the proposed works would not intercept with any known Aboriginal heritage site. This, however, does not absolve the company from complying with the legislative requirements of the Aboriginal Heritage Act 1972.
