LOCAL GOVERNMENT — HON DARREN WEST — COMPLAINTS
      493. Hon MARTIN ALDRIDGE to the Leader of the House representing the Minister for Local Government:
I refer to Legislative Council question on notice 736 in relation to breaches of the Local Government Act 1995 by Hon Darren West.
(1) Which sections of the act or relevant regulations did Mr West breach?
(2) What was the nature of each breach identified?
(3) What was the penalty applied for each breach?
      (4) Does the Minister for Local Government consider it appropriate for executive members of his government to be financially supporting the election of local government councillors?
Hon SUE ELLERY replied:
I thank the honourable member for some notice of the question.
(1) It was part 5A, regulation 30C(1)(a) of the Local Government (Elections) Regulations 1997.
      (2) It was failure as a donor to make a disclosure to the chief executive officer in the manner set out in regulation 30D(1) of the Local Government (Elections) Regulations and within the time set out in regulation 30D(2) of the Local Government (Elections) Regulations.
      (3) It was determined that a breach had occurred concerning only one of the allegations. As is normal practice in the circumstance, a letter reminding the person of interest of their obligation under the regulations was sent.
      (4) There is no statute that prohibits members of Parliament from making donations to candidates in local government elections.
