Parliamentary Questions

Question Without Notice No. 462 asked in the Legislative Council on 23 August 2017 by Hon Alison Xamon

Parliament: 40 Session: 1

MELALEUCA REMAND AND REINTEGRATION FACILITY — CONTRACT BREACH FINES
      462. Hon ALISON XAMON to the minister representing the Minister for Corrective Services:
I refer to the ABC online news report updated on 11 May 2017, stating that Sodexo had been fined three times for breach of contract since it opened in December. I refer also to the answer to my question on notice 61 in which it was stated that Sodexo has not formally been in breach of its contract.
(1) How many times has Sodexo been fined in relation to Melaleuca Remand and Reintegration Facility?
(2) For each of the fines, what was —
      (a) the date;
      (b) the amount; and
      (c) the reason for the fine?
Hon STEPHEN DAWSON replied:
I thank the honourable member for some notice of the question. The Minister for Corrective Services advises —
      (1) There is no contract term in the Melaleuca Remand and Reintegration Facility services agreement relating to ''fine''. This is not a defined term or contract element.
      (2) However, in schedule 1 of the agreement, there is an abatement regime. The following abatements have been issued —
          (a) unlawful release of a prisoner, incident date 16 February 2017, $25 000;
          (b) failure to report, incident date 29 March 2017, $25 000; and
          (c) failure to remedy a PIN, issued 20 April 2017, $25 000.
