43. Hon PETER COLLIER to the minister representing the
Minister for Transport:
I refer to the Kwinana smart
freeway project.
(1) What was the date for practical
completion when the contract was first signed?
(2) Are there any liquidated
damages in the contract for failure to complete the project on time?
(3) If yes to
(2), does the state intend to seek liquidated damages given the project has
been delayed; and, if not, why not?

I thank the Leader of the
Opposition for some notice of the question.
(1) As per the
media statement dated 19 June 2019, the project is due for completion in the
first half of 2020.
(2) This is an
alliance contract and there are no liquidated damages. There are key
performance indicators as part of the contract.
(3) Not applicable.
