EDUCATION — DEPARTMENTAL AMALGAMATION
      452. Hon DONNA FARAGHER to the Minister for Education and Training:
I refer to the minister's answer to question without notice 339 on 29 June 2017 regarding the amalgamation of the Department of Education and Department of Education Services and to the minister's reference that the director general of the Department of Education will be the chief executive officer referred to in section 151 of the School Education Act 1999 and that, therefore, the director general will undertake the functions mentioned in the question.
      (1) Having regard to the provisions of the School Education Act 1999 has the minister sought and/or received either verbal or written advice on whether the same chief executive officer, who principally administers the act as it relates to government schools, can administer part 4 or any other provision of the act relating to students enrolled at non-government schools?
      (2) If yes to (1), will the minister detail the advice provided; and, if not, why not?
Hon SUE ELLERY replied:
I thank the honourable member for the question. Hon Donna Faragher is asking me about a very specific section of the act. She is asking me whether I have received verbal or written advice and then she is asking me to detail the advice provided, without giving me any notice to check the facts. I cannot answer that question today. I am happy to provide the member an answer as soon as I can, but I think given the member wants very precise information —
Hon Donna Faragher: Part 4 relates entirely to non-government schools, if that assists.
Hon SUE ELLERY: I believe the honourable member, but for me to ascertain the nature of any advice I may or may not have received, I really need to check, and that is what I will undertake to do.
