Question

I refer to the Parnparjinya Remote Aboriginal community located north-east of Newman, and ask:

(a) which department or agency is responsible for the ongoing maintenance of the Parnparjinya community housing;
(b) are there regulations, legal frameworks or guidelines in place to ensure this department or agency adequately performs their maintenance responsibilities:
(i) if yes to (b), please elaborate on these guidelines;
(ii) if yes to (b), will the Minister please table:
(A) if no to (ii), why not; and; and
(iii) if no to (b), why not;
(c) what department or agency is responsible for the ongoing maintenance of Parnparjinya’s basic infrastructure;
(d) are there regulations, legal frameworks or guidelines in place to ensure this department or agency adequately performs their infrastructure responsibilities:
(i) if yes to (d), please elaborate on these guidelines;
(ii) if yes to (d), will the Minister please table:
(A) if no to (ii), why not;
(iii) if no to (d), why not;
(e) what department or agency is responsible for carrying out Parnparjinya’s basic municipal services;
(f) are there regulations, legal frameworks or guidelines in place to ensure this department or agency adequately delivers municipal services:
(i) if yes to (f), please elaborate on these guidelines;
(ii) if yes to (f), will the Minister please table:
(A) if no to (ii), why not;
(iii) if no to (f), why not;
(g) what is the current land tenure arrangement with the Parnparjinya community;
(h) who or what organisation owns the land on which the Parnparjinya community is located;
(i) does this organisation have any maintenance responsibilities;
(j) are there any overlapping mining leases with Parnparjinya community land:
(i) if yes to (j), how does this mining lease interact with the current land tenure arrangement; and
(k) has the Minister given any directive that this land will be given to native title:
(i) if yes to (k), when did this happen;
(ii) if yes to (k), how will this directive be carried out;
(iii) if yes to (k), who or what organisation will take on responsibility for housing, infrastructure and municipal maintenance; and
(iv) if no to (k), why not?
Answered on 30 November 2017

(a) The Aboriginal Lands Trust is the responsible entity. However, under an informal management agreement with the community, Pilbara Meta Maya Regional Aboriginal Corporation is contracted by the Department of Communities to deliver tenancy management services to 11 houses. Services include bi-annual property inspections, rent collection and the identification of required property maintenance, delivered through the Head Maintenance Contract.

(b) (i) – (iii) The appropriate regulation for property and tenancy management services is the Residential Tenancies Act 1987. This does not apply to properties managed under informal arrangements, however the Department of Communities does apply public housing like policies and procedures consistent with the principals of the Residential Tenancies Act 1987.

(c) The Aboriginal Lands Trust.

(d) (i) – (iii) The Aboriginal Lands Trust is the responsible entity and this question should be re-directed to the Hon Ben Wyatt MLA, Minister for Aboriginal Affairs.

(e) The Aboriginal Lands Trust.

(f) (i) – (iii) The Aboriginal Lands Trust is the responsible entity and this question should be re-directed to the Hon Ben Wyatt MLA, Minister for Aboriginal Affairs.

(g) – (h) Parnpajinya is situated on Crown Reserve 42835 vested under a Management Order to the Aboriginal Lands Trust, for the purpose of use and benefit for Aboriginal inhabitants. There is no lease to the Aboriginal community corporation.

(i) – (k) The Aboriginal Lands Trust is the responsible entity and this question should be re-directed to the Hon Ben Wyatt MLA, Minister for Aboriginal Affairs.
