686. Hon PETER COLLIER to the minister representing the
Minister for Transport:
I refer to the Matagarup Bridge.
(1) Has practical completion on the
bridge been achieved?
(2) If no to (1), when is practical
completion expected?
(3) If no to (1), who is now
responsible for ongoing works to complete practical completion?
(4) If no to (1),
who is liable for any accidents to the general public while using the bridge
before practical completion?
(5) Did the York
Rizzani joint venture seek, or were they provided by the government, any
indemnities, guarantees or undertakings in relation to any injuries arising
from the public accessing the bridge and surrounding works before practical
completion?
(6) If yes to (5), what
undertakings, indemnities or guarantees were provided?

STEPHEN DAWSON replied:
I thank the honourable Leader of the
Opposition for some notice of the question.
(1) No.
(2) Practical
completion will be granted by Main Roads Western Australia when it is satisfied
that the alliance has completed all the project works in accordance with the
alliance agreement. It is anticipated that this will occur later this year.
(3) The alliance continues to be
responsible for ongoing works to achieve practical completion.
(4) As the bridge
is yet to reach practical completion, liability cover remains with the alliance
in accordance with the terms set out in the alliance agreement.
(5) No.
