Parliamentary Questions

Question Without Notice No. 439 asked in the Legislative Council on 9 May 2019 by Hon Peter Collier

Parliament: 40 Session: 1

HUAWEI — STATE SOLICITOR'S OFFICE — ADVICE

439. Hon PETER COLLIER to the minister representing the Minister for Transport:

I refer to the minister's previous answers in the Legislative Council regarding the involvement of the State Solicitor's Office in the Huawei contract.

(1) Was advice sought from the State Solicitor's Office prior to the signing of the contract?

(2) If no to (1), why not?

(3) Has advice been sought from the State Solicitor's Office since the contract was signed with Huawei; and, if yes, on what date was advice first sought?

(4) If yes to (3), who sought the advice and for what reason?

Hon STEPHEN DAWSON replied:

I thank the Leader of the Opposition for some notice of the question. The following information has been provided by the Minister for Transport.

(1)–(2) The Public Transport Authority sought advice from the State Solicitor's Office during business case development. There is no requirement through a Treasurer's Instruction or Premier's circular that requires SSO advice for a contract such as this.

(3)–(4) The PTA has sought and received advice from the SSO on a number of matters associated with this contract.
