I refer to a recent case heard by the State Administrative Tribunal (SAT), Julie Matheson and Local Government Standards Panel ([2020] WASAT 26). In response to a question of legality put by then Councillor Julie Matheson (regarding incorrect reliance on a section of the Local Government Act to exclude the public from discussion of an agenda item) the SAT Member hearing the appeal said, "This is a question that deserves an answer albeit not the subject of this proceeding", and I ask:
(a) Have you sought an answer to this issue following the conclusion of the appeal:
(i) If not, why not?

The Department is aware that the City of Subiaco has made an annotation to the minutes of the Ordinary Council Meeting of 28 August 2018 to reflect the correct section of the Local Government Act 1995.
