Parliamentary Questions

Question Without Notice No. 913 asked in the Legislative Council on 15 September 2020 by Hon Aaron Stonehouse

Parliament: 40 Session: 1

CEMETERIES ACT — REVIEW

913. Hon AARON STONEHOUSE to the Leader of the House representing the Minister for Local Government:

I refer to the minister's announcement in the other place on 10 September 2020 about a review of the Cemeteries Act 1986.

(1) How does the minister's recent statement differ from the response he offered to question without notice 694 on 27 June 2019 in which he recognised that a review was ''desirable'' but refused to be drawn on a commencement date?

(2) Since it was the minister who raised the matter in the other place, will he now confirm the date upon which the review will commence, the anticipated time period and process for public submissions, and its anticipated conclusion and reporting date?

(3) Will the minister undertake to instruct the Metropolitan Cemeteries Board to halt all future renewal activities at Karrakatta Cemetery until such time as this desirable review has concluded and any recommendations from it have been considered by the government?

Hon SUE ELLERY replied:

I thank the honourable member for some notice of the question.

(1) The minister's statement on 10 September 2020 represented an update to the response provided to question without notice 694 on 27 June 2019. Following the recognition that a review was desirable, the McGowan government has taken action to commence a combined review of the Cemeteries Act 1986 and the Cremation Act 1929.

(2) The minister confirms that the review is expected to commence in October. A publicly available consultation paper will be prepared to provide an opportunity for the community and interested stakeholders to provide feedback. This will determine when the relevant discussion papers are prepared. The review is expected to conclude in late 2021.
