Question

I refer to the registration of real estate agents, and I ask:
(a) are renewal applications that are received early by the Department of Mines, Industry Regulation and Safety refused processing and returned to applicants;
(b) If yes to (a), what timeframe prior to the renewal lapsing or the application being due does the Department consider too early to process; and
(c) why does the Department not hold applications as pending if they are submitted too early and process them later?

Answered on 11 October 2022

(a)            Yes.

(b)            Where an application is received more than three months prior to expiry.

(c)            Applicants must satisfy the Commissioner for Consumer Protection of their character, propriety and fitness to hold a licence, and that that they have sufficient material and financial resources.  This cannot be established if the relevant assessments of these, which accompany an application, such as the National Police History Check or Credit History Report are not current.
