EMERGENCY MANAGEMENT AMENDMENT (TEMPORARY COVID-19 PROVISIONS) BILL 2022

872. Hon JAMES HAYWARD to the Minister for Emergency Services:

I refer to the Emergency Management Amendment (Temporary COVID-19 Provisions) Bill 2022.

(1) Can the minister describe a potential scenario in which an authorised COVID-19 officer would need to confiscate property without a warrant and explain why this provision is needed?

(2) Can the minister describe a potential scenario in which an authorised COVID-19 officer would need to require a person to submit to an infection prevention measure; and, how much force will be able to be used?

(3) How will authorised COVID-19 officers be trained to make medical decisions that will be enforced upon individuals to ensure individual medical conditions are considered appropriately on a case-by-case basis?

(4) Does the minister understand the concerns that many in the community have raised in emails about this proposed legislation?

The PRESIDENT: Before I give the call to the Minister for Emergency Services, I would just like to point out that that question was long and requested a great deal of information. I will check whether the minister is able to provide an answer.

Hon STEPHEN DAWSON replied:

I thank the member for some notice of the question. The level of detail requested in the question would require an answer that would fall foul of standing order 106, which requires that answers to questions be concise and relevant. I understand that my office has reached out to the member's office to arrange a briefing on the bill to provide him with a level of detail on the legislation.
