ATTORNEY GENERAL —
LEGISLATIVE AGENDA
1288. Hon MICHAEL MISCHIN to the Leader of the House
representing the Attorney General:
I refer to the Attorney General's
partial answer to my question without notice of 10 November 2020.
(1) As to the
asbestos diseases compensation legislation, what are the ''options for
reform'' being considered by the government and what precisely is the ''significant
further work'' that is being done?
(2) As to the
amendments to the Coroners Act 1996 that are currently ''in the drafting
process'', has cabinet approval to draft been granted; and, if so, on
what date and how many drafts have been prepared?
(3) As to the drafting of a bill to replace the
Criminal Law (Mentally Impaired Accused) Act 1996, which the government ''continues
to progress'', has cabinet approval to draft been granted; and, if so,
on what date and how many drafts have been prepared?
Hon SUE
ELLERY replied:
I thank the honourable member for
some notice of the question.
(1) The options for reform that are being considered
are set out in the final report of the Law Reform Commission of Western Australia's
''Project 106—Provisional Damages and Damages for Gratuitous
Services''. The significant further work relates to complex legal and
practical issues that have arisen during consideration of the reform options.
(2)–(3) As
the honourable member was informed yesterday, these bills are in the drafting
process. The process is the same now as it was when the member was in
government, in that cabinet approval to draft is required before the drafting
process commences.
