Parliamentary Questions

Question Without Notice No. 1208 asked in the Legislative Council on 22 November 2022 by Hon Dr Brad Pettitt

Parliament: 41 Session: 1

YOUTH DETENTION

1208. Hon Dr BRAD PETTITT to the parliamentary secretary representing the Minister for Corrective Services:

I refer to the recent Supreme Court decision of 25 August 2022 that declared that the lockdown of the 14-year-old applicant was unlawful, and recent media reports that Judge Quail was informed that those lockdowns would continue for the rest of the year, and most likely into the first quarter of 2023.

Given that the review of the Young Offenders Act 1995 is expected to take 12 months, what action has the Department of Justice taken since 25 August 2022 to enable youth detention to comply with the Supreme Court's decision, which found that the implementation of extensive rolling lockdowns was unlawful?

Hon MATTHEW SWINBOURN replied:

As mentioned to the member behind the chair, I do not have an answer to that question today, but an answer will be provided tomorrow.
